GENERAL TERMS AND CONDITIONS OF BUSINESS STORIES BY LEA, LEA GROM S.P.

1. Introduction

These general terms and conditions of business apply to the sale of goods and services published on the website https://www.storiesbylea.com/, the online store of Stories by Lea, Lea Grom sole proprietorship (hereinafter: Stories by Lea). When placing an order, Stories by Lea expressly informs the buyer of goods or services (hereinafter: the buyer) about the entire text of the General Terms and Conditions of Business of Stories by Lea (hereinafter the General Terms). It is considered that the buyer is acquainted with the General Terms and fully agrees with them and accepts them when placing an order. Stories by Lea reserves the right to change the content published on the website https://www.storiesbylea.com/.

Stories by Lea provides services within the scope of its current offer of goods and services and in accordance with its capabilities. Stories by Lea reserves the right to refuse the sale of goods or services or cancel an order in certain circumstances.

2. General

All content published on https://www.storiesbylea.com/ is the property of Stories by Lea and may only be used for non-commercial purposes. Without the permission of Stories by Lea, it may not be copied, reproduced, or distributed in any other way.

The purchased goods and services may be used by the buyer solely for their own needs, and without specific prior written agreement with Stories by Lea, they may not be resold or otherwise disposed of. Otherwise, this constitutes abuse of this right by the buyer and a violation of the concluded contract, for which the buyer is liable for damages.

3. Accessibility of Information

In accordance with Article 25.b of the Consumer Protection Act (ZVPot, Official Gazette of the Republic of Slovenia, No. 98/04 and amendments), Stories by Lea undertakes to always provide the following information to the buyer:

  1. The main characteristics of the goods or services to the extent that corresponds to the data carrier and the goods or services;

  2. The company, the registered office of the company, and the company's telephone number, if available;

  3. The final price of the goods or service, including taxes, or the method of calculating the price if it cannot be calculated in advance due to the nature of the goods or service;

  4. Information on any additional costs of transport, delivery, or dispatch, or a warning that such costs may arise if they cannot be calculated in advance;

  5. Payment terms and conditions and the conditions for the delivery and performance of the service, the delivery time of the goods, or the performance of the service, where necessary;

  6. Information about the complaint procedure at the company;

  7. Information about liability for material defects;

  8. The possibility and conditions of after-sales services and voluntary guarantees, where necessary;

  9. The duration of the contract, where appropriate, and the conditions for withdrawal from a contract concluded for an indefinite period or a contract with automatic renewal;

  10. Functionality, including valid measures for the technical protection of digital content, where appropriate;

  11. Information on the compatibility of digital content with the hardware and software with which the company is familiar or should be familiar.

When the contract is concluded at a distance, Stories by Lea, in accordance with Article 43.b of the ZVPot, will also provide information about:

  1. The address at which the company actually conducts its business, the telephone number, the fax number, and the company's email address, if available, and, if necessary, also the company's name and registered office on behalf of which it operates and to which the buyer can address their complaint;

  2. The address of the company's registered office, if different from the address in the previous point, and, if necessary, the address of the company on behalf of which it operates and to which the buyer can address their complaint;

  3. The costs associated with the use of communication tools, if they differ from the basic tariff;

  4. The conditions, deadlines, and procedure for exercising the right to withdraw from the contract in accordance with Articles 43.č and b43.d of the ZVPot, together with the withdrawal form from the fifth paragraph of Article b43.d of the ZVPot;

  5. A statement that the buyer bears the costs of returning the goods in case of withdrawal from the contract if necessary;

  6. The costs of returning the goods if, in the case of distance contracts, they cannot be returned by mail due to their nature;

  7. The costs that the buyer must pay to the company in accordance with the first paragraph of Article a43.e of the ZVPot if they withdraw from the contract after submitting a request in accordance with the seventh paragraph of Article 43.c or the third paragraph of Article a43.č of the ZVPot;

  8. The non-existence of the right to withdraw from the contract if, in accordance with the fifth paragraph of Article 43.č of the ZVPot, the buyer does not have the right to withdraw, or, if necessary, the circumstances in which the buyer loses the right to withdraw from the contract;

  9. The existence of codes of conduct and access to any codes of conduct;

  10. The minimum duration of the consumer's obligations under the contract, if necessary;

  11. The possibility of out-of-court dispute resolution and other legal remedies used by companies, and their availability, if necessary;

  12. The existence of deposits or other financial guarantees and the conditions related to them, which the buyer must pay or provide at the request of the company, if necessary.

4. Goods and Services of Stories by Lea

4.1. COURSES

Stories by Lea offers online courses with recipes for cakes, sweets, icing creams, techniques for assembling multi-tiered cakes, and various decoration techniques. The courses are prepared based on Lea's own experiences and knowledge and are suitable for participants with both basic and advanced knowledge of baking.

In addition, it also offers the Business Bundle course, where it shares tips and experiences regarding the registration and operation of its own business in the field of baking cakes and pastries (space, NPK education, HACCP system, business plan, etc.). It imparts knowledge gained during the establishment of its own business, which is not equivalent to consultation with a professional HACCP instructor.

A detailed description of the courses with the current price will be published on the website https://storiesbylea-school.thinkific.com/courses/ each time. After making the payment, the buyer can access the courses on the mentioned website. The courses will be online, all written and video content will be uploaded to the website in advance, and subscribers will have unlimited access to the course. Stories by Lea reserves the right to supplement and upgrade the content of the courses even after it has already been published.

4.2. CAKES AND SWEETS

Stories by Lea makes cakes and sweets to order, which means that each one is different, unique, special, and personalized for the one celebrating. Lea finds inspiration for designs in people's stories, nature, architecture, and natural elements. In addition to design, cakes also differ in tastes and the number of tiers, all of which affect the final price, which is determined individually for each customer. Sweets and cakes are freshly made daily and are not frozen; each order is freshly baked and prepared. All ingredients used are of the highest quality. Cakes are made in a facility where traces of nuts, peanuts, milk, eggs, soy, and gluten may be present.

For wedding cakes, an advance payment of EUR 100 is charged upon confirmation of the order, which is deducted from the final amount for the order. The order will not be prepared until the advance payment is received. For birthdays and the remaining amount for wedding cakes, the payment must be settled no later than one week before the customer's event. The order will not be delivered if payment is not made. If the order is placed in the last week before the event, the full payment must be made before delivery.

The ordered goods can be picked up by prior arrangement at Vrhnika. If delivery is arranged by 8:00 PM, the cost is EUR 0.75/km on the Vrhnika-event location-Vrhnika route, and delivery after 8:00 PM costs EUR 1.5/km on the Vrhnika-event location-Vrhnika route. Delivery of wedding cakes is possible throughout Slovenia. If the customer wishes to have an additional service of setting up and designing a dessert table at the event location, this offer is possible starting from EUR 50, by prior arrangement.

Stories by Lea reserves the right to photograph the customer's cakes and desserts before, during, and after delivery for marketing and promotional purposes without compensation to the customer.

4.3. BOOKS

Stories by Lea publishes books with recipes for cakes, sweets, icing creams, techniques for assembling multi-tiered cakes, and various decoration techniques. Books can be ordered via email at storiesbylea@gmail.com or through a contact form, where subscribers must provide their name, surname, address, postal code, and city. Based on the order, a proforma invoice is issued, which is valid for 5 days. In addition to the book's price, the subscriber is charged for shipping.

Payment is only possible via proforma invoice, and the invoice is sent by email no later than 7 days after the package is dispatched at the post office. The book is shipped by mail after payment of the proforma invoice. If the book is not picked up and is returned, Stories by Lea charges an additional EUR 3.5 for resending.

5. Ordering Goods and Services

Cakes, sweets, and books can be ordered via email at storiesbylea@gmail.com. Upon ordering, the customer will receive a proforma invoice for the payment of goods to their email address.

Online courses are ordered through Stories by Lea's online store. To purchase a course, the customer must first create an account on Stories by Lea.

  • Upon accessing their account, the customer can place an order for an online course.

  • The customer has one payment method available, which is through the Stripe interface with a credit card.

  • After successfully completing the payment, the customer will receive a confirmation that their order has been accepted. Additionally, they will receive an order confirmation email with all the details regarding the type of course and the final price.

  • A tax-validated invoice will be sent to the provided email address no later than 7 days after placing the online order.

  • The order is considered confirmed if the customer does not cancel it before delivery.

  • Upon agreement with Stories by Lea, it is also possible to order an online course via email at storiesbylea@gmail.com.

Stories by Lea will keep invoices in electronic form, as required by law, and provide them to customers upon their written request.

6. Prices and Promotional Offers

All prices listed on the website are in euros and include VAT. Prices may change without prior notice. Promotional offers (discounts) may be weekly or daily and are shaped based on demand and available stock.

Taxable persons must provide their identification number or tax number and company information when ordering. Prices are valid from January 20, 2022, until further notice or changes.

7. Payment Methods

Payment for ordered cakes, sweets, or books is made by bank transfer to the bank account of Stories by Lea: SI56 6100 0002 4761 634.

Payment for online courses can be made in the following ways:

  • Payment through the Stripe interface with a credit card,

  • Payment to the bank account.

The deadline for payment by bank transfer is 5 days from the date of the proforma invoice unless specified differently in specific cases.

The same ordering and payment conditions apply to legal entities.

8. Order Cancellation, Contract Termination, and Returns of Goods

CAKES AND SWEETS

Free order cancellation for cakes and sweets (birthday, wedding, or cakes for other occasions) is possible at least 14 days before the event.

If an order is canceled 7-14 days before the event, Stories by Lea retains the advance payment of EUR 100.

If an order is canceled less than 7 days before the event, the customer is obligated to pay the full amount of the order.

Regarding cakes and other sweets, depending on the nature of the ordered goods (custom-made goods, fast-perishable goods, etc.), the customer does not have the right to withdraw from the contract (a legal exception based on Article 43.č, paragraphs 2 and 3 of the Consumer Protection Act).

Stories by Lea reserves the right to cancel a confirmed order in the event of force majeure in accordance with applicable law. In such a case, the advance payment will be refunded to the customer.

ONLINE COURSES

Customers can cancel their order for online courses at any time before the delivery of digital content by notifying their cancellation to storiesbylea@gmail.com.

Due to the nature of the delivered goods, customers agree that, by accepting these general terms, they do not have the right to withdraw from the contract (a legal exception based on Article 43.č, paragraphs 4 and 13 of the Consumer Protection Act).

BOOKS

Customers can cancel their order for books at any time before delivery.

In accordance with Article 43.č of the Consumer Protection Act, customers have the right to withdraw from the contract within 14 days of receiving the book without having to provide a reason for their decision. The notice of withdrawal from the contract should be sent to the email address storiesbylea@gmail.com. The customer must return the received books undamaged and unused within fourteen days of sending the withdrawal notice. Returning the received books within the withdrawal period is considered a notice of withdrawal from the contract. The customer bears the cost of returning the goods. Once the customer returns the received books, Stories by Lea will refund the purchase price as soon as possible, but no later than within fourteen days after receiving the notice of withdrawal from the contract or the returned goods, by making a transfer to the transaction or personal account.

If the goods or services do not function properly or do not meet the customer's expectations, the customer has the right to assert a warranty claim in accordance with the Consumer Protection Act.

9. Warranty Claims

In accordance with Article 37 of the Consumer Protection Act, Stories by Lea must deliver the goods in accordance with the contract and is responsible for actual defects in its performance (e.g., it does not have the characteristics necessary for normal use, it does not have characteristics that were expressly agreed upon, etc.).

The customer can assert their rights due to an actual defect if they notify Stories by Lea of the defect within two months from the day when the defect was discovered.

Stories by Lea is not responsible for actual defects in goods that occur after two years have passed since the item was delivered.

The customer can request, at their choice:

  • Repair of the defect in the goods,

  • A refund of the amount paid in proportion to the defect,

  • Replacement of the goods,

  • A refund of the amount paid.

When asserting rights based on an actual defect, the customer must describe the defect more precisely in the defect notification and allow Stories by Lea to inspect the product.

If the defect is not disputed, Stories by Lea must, as soon as possible and no later than within 8 days, meet the customer's request. If there is a dispute about the defect, Stories by Lea must provide a written response to the customer within 8 days.

If the customer believes that the purchased goods or services have an actual defect, they should contact Stories by Lea at storiesbylea@gmail.com and provide the invoice or order number. A suitable solution will be offered to the customer as soon as possible.

In the case of damage to fast-perishable goods (e.g., cakes, sweets), customers are advised to immediately inform Stories by Lea of the damage; otherwise, it may be difficult to prove that the damage existed at the time of delivery. In this case, the customer is requested to store the cake or other sweets appropriately in a cool place and return them the next working day to prevent further damage to the goods. If the cake or sweets were damaged after delivery to the customer's location, Stories by Lea is not responsible. Nevertheless, upon the customer's request, the cake or sweets can be repaired for an agreed-upon fee.

10. Liability

Stories by Lea is not responsible for improper handling and storage of cakes and sweets.

Cakes must be stored in a cool place and protected from direct sunlight. It is recommended to store them in the boxes in which they were received.

The purchaser of books and courses uses them at their own risk. Stories by Lea is not responsible for any issues that may arise due to their improper use. The purchaser assumes full responsibility for their decisions within the courses offered by Stories by Lea and any resulting potential damage. The courses offered by Stories by Lea are not a substitute for appropriate licenses and education in the field of food handling under any circumstances.

Stories by Lea shall not be liable to the purchaser or any third party for any direct or indirect damage that may occur to the purchaser or any third party in the provision of services under these General Terms and Conditions, except in cases of deliberate misconduct or gross negligence, with the conduct of Stories by Lea being assessed according to the standard of care of a good professional.

Stories by Lea shall not be liable for any damage resulting from disruptions to operations that are beyond its control; this applies in particular to cases of force majeure or unforeseen events such as war, natural disasters, strikes, terrorist actions, disruptions to the communication or information system caused by factors beyond the control of Stories by Lea, actions of authorities and regulatory bodies, the purchaser's failure to observe certain security measures, etc.

11. Fulfillment of Obligations and Enforcement of Rights

The purchaser is obliged to pay for all services provided and goods delivered in accordance with the price applicable at the time of the service or goods delivery.

Stories by Lea sends invoices to the purchaser in electronic form, and the purchaser must ensure the continuous and uninterrupted operation of the email address to which Stories by Lea sends these invoices. The purchaser must promptly inform Stories by Lea of any changes to their email address.

In the event of a delay in payment of (part of) due monetary obligations according to the invoice, the purchaser shall also pay the legal default interest to Stories by Lea, calculated from the unpaid monetary obligations from the due date until the payment date at the interest rate for default interest determined by the applicable regulations.

If the purchaser does not fulfill its due obligations to Stories by Lea according to the invoice, the purchaser must also pay Stories by Lea and the person authorized by Stories by Lea to assert or enforce this obligation against the purchaser, all costs of actions and activities carried out by Stories by Lea and the authorized person, in accordance with applicable regulations (e.g., the Law on Court Fees, the Lawyer's Tariff Act, etc.).

Stories by Lea may enforce payment of any of its matured claims against the purchaser at any time in legal and other appropriate proceedings in accordance with applicable regulations. Stories by Lea has the right to outsource the calculation and execution of charging for services to a third party.

12. Personal Data Processing

The data controller of personal data is the operator of the Stories by Lea website, Lea Grom s.p., Stara Vrhnika 133, 1360 Vrhnika (hereinafter referred to as the controller).

Stories by Lea undertakes to carefully protect the purchaser's personal data (name, surname, address, and email address). Each purchaser of Stories by Lea, by accepting these General Terms and Conditions, allows the use and processing of the provided personal and other data for the purpose of order processing and other necessary communication. The controller undertakes to use personal data only for the purpose for which they were obtained. The user, by registering, is informed about the handling of personal data and consents to the processing and storage of personal data until revoked. Data about the purchaser is processed and stored in a manner and within the time frame with a specific and legitimate purpose. The controller guarantees the privacy of personal data and handles them in accordance with the Personal Data Protection Act (ZVOP-1).

The controller of personal data will not disclose them to third parties, except in cases provided for by law. The controller reserves the right to provide data about the user or user activity to state authorities if they conduct proceedings against an individual user on suspicion of violating the applicable legislation.

The purchaser also agrees to receive emails related to the Stories by Lea website. These messages may contain advertising messages from the business partners of the controller. The purchaser can request that the controller permanently or temporarily cease using their personal data for sending advertising messages. To unsubscribe from receiving these messages, the purchaser needs to click on the UNSUBSCRIBE button in the received email, and the controller will disable the use of personal data for the purpose of direct mail within 15 days of receiving the unsubscribe notice. The unsubscribe applies to all electronic messages, except those related to the operation of the Stories by Lea website or the provision of Stories by Lea services. The purchaser expressly consents to the controller processing and using their personal data, which they voluntarily provided for the purpose of using Stories by Lea services, and expressly consents to the controller using the data collected for the purpose of direct marketing until revoked in accordance with the Personal Data Protection Act.

13. Cookies

The installation of cookies on the Stories by Lea website is regulated in accordance with the Electronic Communications Act (ZEKom-1). The operator of the website will store or gain access to data stored in the user's terminal equipment under the condition that the user has consented to it. Before that, the user is clearly and comprehensively informed about the operator and the purposes of processing this data. The user's consent, given freely and expressing their will, is obtained by the operator of the website before the cookie is installed or user data is collected; based on the user's notification of sending and the purpose of the cookie. The user is informed on the Stories by Lea website about which information will be stored in the cookie, for what purpose, and what is the validity period of the cookie that the user will accept. The user is aware that the cookie will enable the advertising provider to collect data about visits to other websites, displayed advertisements, etc., and the user is provided with an explanation of the cookie and its use, as well as information about monitoring through cookies. The decision to accept the cookie is up to the user. The user's acceptance of the cookie is considered as clear consent (marking), which the user can give when using the Stories by Lea website or when ordering goods or services. The fact that the user accepted the cookie is considered valid consent for subsequent data collection arising from this cookie. The user can also withdraw their consent. The operator of the website will inform users that monitoring through cookies is taking place.

14. Dispute Resolution

Stories by Lea makes its best efforts to resolve any disputes amicably. Complaints can be submitted in writing by email to the address: storiesbylea@gmail.com. If an agreement cannot be reached, the dispute will be resolved by the competent court in Ljubljana.

In accordance with legal provisions, Stories by Lea does not recognize any out-of-court dispute resolution service provider as competent for resolving consumer disputes that the purchaser may initiate in accordance with the Consumer Dispute Resolution Act.

15. Validity of the General Terms and Conditions

These General Terms and Conditions enter into force on January 20, 2022. The purchaser will be informed by email of any changes that affect existing relationships and are made to these General Terms and Conditions.
